Terms & Indemnification Waiver

These Terms & Conditions and Indemnification Waiver ("Agreement") govern the provision and use of event services ("Services") provided by LV Foam Party, an event management company operating in the Las Vegas metropolitan area. By booking or participating in an LV Foam Party event, you ("Customer") agree to the following:

1. Booking & Payment
Booking: All reservations must be made online via www.lvfoamparty.com or by contacting us directly.

Submission of a booking request does not guarantee availability until confirmed by LV Foam Party.
Event details including date, time, location, and services must be confirmed at least 1 day prior to the event

Payment Due Date: Payment for your event is due in advance, at least one (1) calendar day prior to the scheduled event date. Cash or check payment will be collected upon arrival to set up for your event. If payment is not received, LV Foam Party reserves the right to cancel or reschedule the event at its sole discretion.

Accepted Payment Methods: We accept credit cards (with a 5% processing fee), cash, company/school/church checks (upon delivery), Zelle, ACH, and cryptocurrency.

Refunds & Cancellations:

Cancellations made by the Customer at least five (5) days prior to the scheduled event are eligible for a full refund.
Cancellations made less than five (5) days before the event may not be eligible for a refund. Exceptions may be considered at LV Foam Party's sole discretion if the event slot is rebooked.
If payment has not yet been made, cancellation does not incur a fee, but the Customer may forfeit priority reservation for future dates.

2. Service Details
LV Foam Party staff will arrive in advance to set up, will operate, and clean up all foam party equipment as part of each booking.

The Customer must provide access to the following:

Outdoor area of at least 15ft x 15ft or more depending on the services booked
Water supply within 50ft
Power source within 100ft of the event area

While we strive for a hassle-free experience, the Customer acknowledges that foam dispersion can be significantly affected by weather conditions—especially wind. LV Foam Party is not liable for diminished foam experience or event interruption due to wind or other environmental factors beyond our control.

3. Safety & Conduct
LV Foam Party events are suitable for all ages. There are no age restrictions for participation.
For the safety of all guests and personnel, LV Foam Party staff reserve the right to:

Remove any individual(s) from the event area as necessary
Pause or terminate foam production at any time to maintain a safe environment

The Customer is responsible for managing guest behavior and ensuring compliance with safety guidelines as directed by LV Foam Party staff.

LV Foam Party is not responsible for supervision of minors. Adult hosts should provide necessary supervision throughout the event.

4. Customer Responsibilities

The Customer must ensure that the event location meets the venue requirements provided at the time of booking.
Customer is responsible for ensuring the event area is safe and accessible
Customer is responsible for any damage to our equipment during the event
The Customer is responsible for notifying staff of any severe allergies among guests prior to the event.
The Customer should inform LV Foam Party of any site-specific rules, restrictions, or requirements upon booking, particularly for events at schools, churches, or other institutions.

5. Liability Release and Indemnification

5.1 ACKNOWLEDGMENT OF RISK AND ASSUMPTION OF LIABILITY
By executing this Agreement, the undersigned Customer ("Customer," "Indemnitor," or "Host") acknowledges and agrees to the terms set forth herein regarding the provision of foam entertainment services by LV Foam Party, a business entity ("Company," "Indemnitee," or "Service Provider").

5.2 RELEASE OF LIABILITY
Customer hereby voluntarily and knowingly assumes all risks, hazards, and dangers associated with or arising out of the foam entertainment services provided by Company, including but not limited to risks of bodily injury, death, property damage, or other loss that may result from participation in or attendance at the foam entertainment event ("Event"). Customer expressly releases, discharges, and holds harmless Company, its officers, directors, employees, agents, contractors, and representatives from any and all claims, demands, actions, causes of action, damages, losses, costs, or expenses of any nature whatsoever, whether known or unknown, which may arise out of or relate to the Event.

5.3 INDEMNIFICATION COVENANT
Customer hereby agrees to indemnify, defend, and hold harmless Company from and against any and all claims, demands, actions, suits, damages, liabilities, losses, settlements, judgments, costs, and expenses (including but not limited to reasonable attorneys' fees and costs) which may be asserted against, imposed upon, or incurred by Company arising out of or relating to:

Any bodily injury, death, or property damage sustained by any person during or in connection with the Event;
Any acts or omissions of Customer, Customer's guests, invitees, or attendees;
Any breach of this Agreement by Customer;
Any violation of applicable laws, regulations, or ordinances by Customer or Event attendees.

5.4 FINANCIAL RESPONSIBILITY AND INSURANCE OBLIGATIONS
Customer acknowledges and agrees that:

Primary Financial Responsibility: Customer assumes primary financial responsibility for all medical expenses, damages, losses, or other costs arising from injuries or incidents occurring during the Event, regardless of fault or negligence.

Insurance Coverage: Customer represents and warrants that they maintain adequate homeowner's, renter's, or general liability insurance coverage that will serve as the primary coverage for any claims arising from the Event. Customer agrees that their insurance policy shall be primary and non-contributory with respect to any coverage maintained by Company.

Coverage Adequacy: Customer acknowledges that Company has made no representations regarding the adequacy of Customer's insurance coverage and that Customer is solely responsible for ensuring sufficient coverage limits.

5.5 SCOPE OF INDEMNIFICATION
The indemnification obligations set forth herein shall extend to all claims arising from:

Slip and fall incidents on foam-covered surfaces
Allergic reactions to foam products or materials
Injuries resulting from participant interactions or collisions
Property damage to Customer's premises or personal property
Damage to third-party property
Any failure to follow safety instructions or guidelines
Inadequate supervision of minors or guests
Pre-existing medical conditions exacerbated by Event participation

5.6 ADDITIONAL LIMITATIONS
LV Foam Party is not responsible for any:

Property damage caused by guests or by failure of the Customer to follow guidelines
Lost, stolen, or damaged items belonging to Customer or guests
Injuries, allergic reactions, or accidents resulting from the Customer or guests' actions or misuse of equipment

LV Foam Party products are hypo-allergenic, eco-friendly, and safe for use on grass and outdoor surfaces.

Some color foam products may cause staining on certain surfaces and clothing. While color typically washes out or fades from most materials, LV Foam Party is not responsible for any lasting stains or discoloration that may occur.

Glow foam additives and color foam products may temporarily discolor pools, pool water, pool surfaces, surrounding areas, clothing, or other materials. While such discoloration is typically temporary and may be corrected through normal cleaning or routine pool maintenance, LV Foam Party is not responsible for any cleaning costs, chemical treatments, staining, discoloration, or other effects resulting from the use of glow or color foam products.

6. Photography & Media
By booking our services, Customer consents to LV Foam Party taking photographs and videos during the event for promotional purposes. If you do not consent, please notify us in writing before the event.

7. Force Majeure
LV Foam Party is not liable for any failure or delay in the performance of its services due to events beyond its reasonable control, including but not limited to severe weather, acts of God, equipment failure, or government restrictions.

In the event of unforeseen circumstances such as adverse weather, LV Foam Party may terminate or reschedule the event without penalty.

8. Legal Enforceability
This Agreement shall be binding upon Customer's heirs, successors, assigns, and legal representatives. If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect. This Agreement shall be governed by the laws of Nevada, and any disputes shall be subject to the exclusive jurisdiction of the courts of Clark County, Nevada.

9. Modifications
LV Foam Party reserves the right to modify these Terms at any time. The latest version of the Terms will always be available at www.lvfoamparty.com or by request.

10. Acknowledgment of Understanding
By accepting these Terms & Conditions during online booking, the Customer acknowledges that they have read, understood, and voluntarily entered into this Agreement with full knowledge of its legal consequences.

Customer further acknowledges that they have been advised to consult with legal counsel before executing this document and have either done so or voluntarily waived such consultation.
